Australia: Important changes to gene technology legislation take effect on 1 July 2007

Included are changes to:

  • the classification of dealings with GMOs into Exempt dealings, Notifiable Low Risk Dealings (NLRDs) and licensable dealings
  • the containment requirements of Exempt dealings and Notifiable Low Risk Dealings (NLRDs)
  • the assessment process and timeframes for applications for Dealings Involving Intentional Release (DIR) into the Australian environment
  • applications for variation of a licence to deal with a GMO (now with a statutory timeframe)
  • emergency powers –emergency powers have been introduced to the Act, giving the Minister the ability to expedite the approval of a dealing with a GMO in an emergency
  • inadvertently dealing –the Regulator has been provided with the power to issue a licence for disposal of a GMO to persons who find themselves inadvertently dealing with an unlicensed GMO
