Bayer CropScience LP
has settled its lawsuit with Makhteshim Agan of North America
regarding several patents related to Bayer’s Ginstar™ cotton
defoliant product. Makhteshim has agreed to pay Bayer an
undisclosed amount in return for a non-exclusive sublicense for
the patents related to the lawsuit.
Bayer filed a lawsuit in U.S. District Court in October 2006
alleging infringement by Makhteshim of six Ginstar-related
patents. With the settlement by Makhteshim, Bayer will not
pursue that litigation.
Bayer developed Ginstar cotton defoliant to provide superior
defoliation and re-growth inhibition that leads to higher value
cotton at harvest. It is designed to deliver a clean, consistent
drop of foliage under cool, dry and other challenging
conditions.
