The U.S. Department of Agriculture
has issued certificates of protection to developers of 18
varieties of seed-reproduced and tuber-propagated plants. They
include bluegrass, fescue, lettuce, potato, paspulum, soybean
and tomato.
The certificates are being issued under the Plant Variety
Protection Act. The certificates require that the varieties be
new, distinct, uniform and stable. The owners will have the
exclusive right to reproduce, sell, import and export their
products in the United States for the duration of protection.
The 18 certificates are:
- the Excursion variety of
Kentucky bluegrass, developed by J.R. Simplot
Company, Post Falls, Idaho;
- the Arrow variety of
Kentucky bluegrass, developed by Rutgers, The State
University of New Jersey, New Brunswick, NJ & ZSeeds, LLC,
Berlin, Md.;
- the 5BAB*, Fury, Coronado
TDH, and Virtue II varieties of tall fescue,
developed by Pure-Seed Testing, Inc., Hubbard, Ore.;
- the NIZ 44-4704 variety of
lettuce, developed by Nickerson-Zwaan, The
Netherlands;
- the Constanza variety of
lettuce, developed by Seminis Vegetable Seeds, Inc.,
Oxnard, Calif.;
- the Sidewinder and King
Cobra varieties of lettuce, developed by Central
Valley Seeds, Inc., Salinas, Calif.;
- the Ivory Crisp variety of
potato, developed by University of Idaho, developed
by Moscow, Idaho;
- the Villetta Rose variety
of potato, developed by Wisconsin Alumni Research
Foundation, Madison, Wis.;
- the Sea Spray* variety of
seashore paspulum, developed by Pure-Seed Testing,
Inc., Hubbard, OR, & University of Georgia Research Fdtn.,
Inc., Athens, Ga.;
- the Sheyenne* variety of
soybean, developed by NDSU Research Foundation,
Fargo, N.D.;
- the D4127789 variety of
soybean, developed by Monsanto Technology, L.L.C., St.
Louis;
- the 92Y20 and 94Y90
varieties of soybean, developed by Pioneer Hi-Bred
International, Inc., Johnston, Iowa; and
- the SENG 9171 variety of
tomato, developed by Syngenta Seeds, Inc., Boise,
Idaho.
* In the United States, seed of
this variety shall be sold by variety name only as a class of
certified seed, and shall conform to the number of generations
specified by the owner of the rights (84 STAT. 1542, as amended,
7 U.S.C. 2321 ET SEQ).
USDA’s Agricultural Marketing Service administers the Plant
Variety Protection Act, which provides time-limited marketing
protection to developers of new and distinct seed-reproduced and
tuber-propagated plants ranging from farm crops to flowers.
