USDA/PVPO grants protection to 58 new plant varieties

The U.S. Department of Agriculture has issued certificates of protection to developers of 12 new varieties of seed-reproduced and tuber-propagated plants. They include barley, tomato and wheat.

The certificates are being issued under the Plant Variety Protection Act. The certificates require that the varieties be new, distinct, uniform and stable. The owners will have the exclusive right to reproduce, sell, import and export their products in the United States for the duration of protection.

The 12 certificates are:

  • the Celebration variety of barley, developed by Busch Agricultural Resources, LLC, Ft. Collins, CO;
  • the XP 08520689 variety of garden pea, developed by Seminis Vegetable Seeds, Inc., Oxnard, CA;
  • the PICUS and FDS142081 varieties of tomato, developed by Seminis Vegetable Seeds, Inc., Oxnard, CA;
  • the Bill Brown* variety of common wheat, developed by Colorado Wheat Research Foundation, Centennial, CO;
  • the AP402 CL2* and AP503 CL2* varieties of Hard White Winter Wheat, developed by Syngenta Seeds, Inc., Junction City, KS;
  • the 25R39 variety of common wheat, developed by Pioneer Hi-Bred International, Inc., Windfall, IN;
  • the AGS2020 variety of common wheat, developed by University of Georgia Research Foundation, Athen, GA;
  • the 9700* variety of common wheat, developed by Monsanto Company, Creve Coeur, MO; and
  • the Mace and Anton varieties of common wheat, developed by The United States Government, as represented by the Secretary of Agriculture, Washington, D.C.
  • the I059908, I062687, I028727, I285302, I285287, I285291, I062696, I135168, I090372, I106999, I119163, I533766, I512243, I900105, I057391, I226218, I006605, I216556, I226211, I119153, I135160, I136799, I133314, and I170094 varieties of field corn, developed by Monsanto Technology LLC, Creve Coeur, Mo.;
  • the 4228AA variety of pepper, developed by Syngenta Seeds, Inc., Boise, Idaho;
  • the PAS490446, PAS490444, PAS490445, PAS553643, and PAS490443 varieties of zinnia, developed by Ball Horticultural Company, West Chicago, Ill.
  • the Midnight II variety of Kentucky bluegrass, developed by Pure Seed Testing, Inc., Hubbard, Ore.; and Rutgers, the State University of New Jersey, New Brunswick;
  • the Casablanca variety of Kentucky bluegrass, developed by Pure Seed Testing, Inc., Hubbard, Ore.;
  • the Alexa variety of Kentucky bluegrass, developed by J.R. Simplot Company, Post Falls, Idaho;
  • the Virtuoso variety of tall fescue, developed by DLF International Seeds, Halsey, Ore.;
  • the Brockton variety of tall fescue, developed by NexGen Turf Research, LLC, Albany, Ore.; and
  • the 94Y60, 95Y20, RJS37002, RJS44001, RJS03001, RJS15002, RJS49001, RJS15001, RJS25001, RJS41001, and RJS39001 varieties of soybean, developed by Pioneer Hi-Bred International, Inc., Johnston, Iowa.

* In the United States, seed of this variety shall be sold by variety name only as a class of certified seed, and shall conform to the number of generations specified by the owner of the rights (84 STAT. 1542, as amended, 7 U.S.C. 2321 ET SEQ).

USDA’s Agricultural Marketing Service administers the Plant Variety Protection Act, which provides time-limited marketing protection to developers of new and distinct seed- reproduced and tuber-propagated plants ranging from farm crops to flowers.
