The U.S. Department of Agriculture has issued certificates of
protection to developers of 14 new varieties of seed-reproduced
and tuber-propagated plants. They include bentgrass, bluegrass,
fescue, lettuce, lobelia, muskmelon, soybean, wheat and vinca.
The certificates are being issued under the Plant Variety
Protection Act. The certificates require that the varieties be
new, distinct, uniform and stable. The owners will have the
exclusive right to reproduce, sell, import and export their
products in the United States for the duration of protection.
The 26 certificates are:
- the Barvado* variety of
tall fescue, developed by Barenbrug Holland B.V.,
Oosterhout, the Netherlands and Rutgers, The State of
University of New Jersey, New Brunswick, N.J.;
- the Estival variety of
lettuce, developed by Agriculture and Agri-Food Canada,
Lacombe, Alberta, Canada;
- the Lilac Splash variety
of annual lobelia, developed by Ball Horticultural
Company, West Chicago, Ill.;
- the WSH 39-1046 AN variety
of muskmelon, developed by Seminis Vegetable Seeds,
Inc., Oxnard, Calif.;
- the 90Y40, 91Y90,
RJS36001, RJS34002, and RJS34001 varieties of soybean,
developed by Pioneer Hi-Bred International, Inc., Johnston,
Iowa;
- the Carter and Goliath
varieties of common wheat, developed by WestBred,
LLC, Bozeman, Mont;
- the Pacifica Dark Red,
Pacifica Really Red, and Pacifica Burgundy Halo varieties of
vinca, developed by Ball Horticultural Company, West
Chicago, Ill.
- the 007* variety of
creeping bentgrass, developed by Rutgers University, New
Brunswick, N.J., and R.H. Hurley, East Stroudsburg, Pa.;
- the Mercury variety of
Kentucky bluegrass, developed by Pickseed West, Inc.,
Albany, Ore., and Rutgers, The State University of New
Jersey, New Brunswick, N.J.;
- the Blue Velvet and Ginney
varieties of Kentucky bluegrass, developed by J.R.
Simplot Company, Post Falls, Idaho;
- the Forrest Green variety
of tall fescue, developed by Blue Moon Farms, L.L.C.,
Lebanon, Ore.;
- the Lucan variety of
lettuce, developed by Syngenta Seeds, Inc., Nampa,
Idaho;
- the Torreto, Unisun, and
Ridgeline varieties of lettuce, developed by Orsetti
Seed Company, Inc., Hollister, Calif.;
- the PS 06516090 variety of
lettuce, developed by Seminis Vegetable Seeds, Inc.,
Oxnard, Calif.; and
- the RJS26001and RJS33001
varieties of soybean, developed by Pioneer Hi-Bred
International, Inc., Johnston, Iowa.
* In the United States, seed of
this variety shall be sold by variety name only as a class of
certified seed, and shall conform to the number of generations
specified by the owner of the rights (84 STAT. 1542, as amended,
7 U.S.C. 2321 ET SEQ).
USDA’s Agricultural Marketing Service administers the Plant
Variety Protection Act, which provides time-limited marketing
protection to developers of new and distinct seed-reproduced and
tuber-propagated plants ranging from farm crops to flowers.
