Bacillus thuringiensis Cry1A.105 protein; Time limited
exemption from the requirement of a tolerance
AGENCY: Environmental Protection Agency (EPA).
ACTION: Final rule.
SUMMARY: This regulation establishes an 18-month exemption from
the requirement of a tolerance for residues of the Bacillus
thuringiensis Cry1A.105 protein in or on the food and feed
commodities cotton seed, cotton seed oil, cotton seed meal,
cotton hay, cotton hulls, cotton forage and cotton gin
byproducts when used as a plant-incorporated protectant.
Monsanto Company submitted a petition to EPA under the Federal
Food, Drug, and Cosmetic Act (FFDCA), requesting a time-limited
exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of Bacillus thuringiensis Cry1A.105 protein in or on
the food and feed commodities cotton seed, cotton seed oil,
cotton seed meal, cotton hay, cotton hulls, cotton forage and
cotton gin byproducts. This tolerance exemption expires and is
revoked on November 22, 2010.
DATES: This regulation is effective May 20, 2009. Objections and
requests for hearings must be received on or before July 20,
2009, and must be filed in accordance with the instructions
provided in 40 CFR part 178 (see also Unit I.C. of the
SUPPLEMENTARY INFORMATION).
