Bayer CropScience has successfully ended a patent infringement dispute in China with the two Chinese companies Jiangsu Tian Rong Group Ltd. (Tian Rong) and Yixing Hua Dong Agrochemical Company Ltd. (Hua Dong), and in so doing has defended its patent for the safener mefenpyr.
Bayer CropScience had initiated litigation against Tian Rong and Hua Dong for infringing its mefenpyr patent. In January 2009, the Wuxi intermediate court of first instance ruled in favor of the Bayer subgroup. The two defendants appealed the decision to Jiangsu High Court in March. Recently, however, the decision of the first instance court became effective due to the withdrawal of the appeal by Tian Rong and Hua Dong. Moreover, under Jiangsu High Court’s mediation, a settlement was reached between Bayer CropScience and the two companies, under which Tian Rong and Hua Dong undertook to cease the infringing acts. Bayer CropScience will further receive damages and a public apology from the infringer.

Tian Rong unlawfully produced mefenpyr, a proprietary Bayer CropScience safener that is mixed with fenoxaprop-P-ethyl and other active ingredients.
Tian Rong and Hua Dong sold the product to Chinese farmers and to customers in other Asian countries. Dr. Jesse said: "Counterfeiting is a serious concern for all stakeholders. The use of unlicensed products can endanger the health of farmers and consumers, damage crops or destroy them completely, and harm the environment. Furthermore, it can cause significant economic damage to farmers, the entire food value chain and our industry."
Einigung im Berufungsverfahren in China: Bayer CropScience verteidigt Patent für den Safener Mefenpyr
Bayer CropScience hat seinen Patentverletzungsstreit mit den beiden chinesischen Firmen Jiangsu Tian Rong Group Ltd. (Tian Rong) und Yixing Hua Dong Agrochemical Company Ltd. (Hua Dong) erfolgreich beendet. Das Unternehmen hat damit sein Patent für den Safener Mefenpyr verteidigt.
Bayer CropScience hatte gegen Tian Rong und Hua Dong ein Verfahren wegen Verletzung seines Mefenpyr-Patents angestrengt. Im Januar 2009 entschied das Gericht in Wuxi in erster Instanz zugunsten des Bayer-Teilkonzerns. Die beiden Beklagten legten im März beim Jiangsu High Court Berufung ein. Vor Kurzem wurde die Entscheidung des Gerichts erster Instanz jedoch rechtskräftig, da die Berufung seitens Tian Rong und Hua Dong zurückgezogen wurde. Darüber hinaus wurde durch Vermittlung (Mediation) des Jiangsu High Courts zwischen Bayer CropScience und den beiden Patentverletzern eine Einigung erzielt, gemäß der sich Tian Rong und Hua Dong dazu verpflichten, patentverletzende Handlungen einzustellen. Ferner erhält Bayer CropScience vom Verletzer des Patents Schadensersatzleistungen und eine öffentliche Entschuldigung.

Tian Rong hatte unrechtmäßig Mefenpyr hergestellt, einen patentierten Safener von Bayer CropScience, der mit Fenoxaprop-P-ethyl und anderen Wirkstoffen gemischt wird. Tian Rong und Hua Dong hatten das Produkt sowohl an chinesische Landwirte als auch an Kunden in anderen asiatischen Ländern verkauft. Dr. Jesse: "Produktnachahmung ist für alle Stakeholder ein ernstes Problem. Die Verwendung unlizenzierter Produkte kann die Gesundheit der Landwirte und Verbraucher gefährden, die Anbaufrüchte schädigen oder vollständig zerstören und der Umwelt schaden. Darüber hinaus kann sie großen wirtschaftlichen Schaden für die Bauern, die gesamte Nahrungsmittel-Wertschöpfungskette und unsere Industrie verursachen."
