USA - Syngenta Viptera corn lawyers launch new website, the Agrisure Viptera Corn Lawsuit site

According to an October 11, 2014 Minneapolis Star Tribune article*, Syngenta Viptera corn lawsuits have already been filed by farmers in 6 states around the nation. The lawsuits allege that Syngenta, AG, a global Swiss agribusiness, willfully misled farmers about importance of China as an export market for corn. According to court documents, plaintiffs have alleged Syngenta told them "the vast majority of corn produced in the US is used domestically," when in fact 20% of corn grown in the U.S. is exported. China has been a major importer of U.S. corn in recent years, and the country’s rejection of corn shipments is projected to be more than $1 billion in losses to the grain industry, according to the October 11 Star Tribune piece.

Farmers in general allege they have been harmed by Syngenta’s actions, citing a recent 11-cent-per-bushel drop in corn prices which they blame on actions taken Syngenta, according to the Star Tribune. The source of that figure, the National Grain and Feed Association, has advocated for Syngenta to halt the sales of Viptera corn, according to the news piece.

Agrisure Viptera and its more recent counterpart, Agrisure Duracade, are genetically-modified (GM) corn seeds that are designed to ward off common corn plant pests including the corn borer, according to an October 15 article** in the Washington Examiner. The seeds feature the genetic trait MIR 162, and were released in 2009 and 2013, respectively. MIR 162 has been approved in the United States and other countries such as Brazil and Argentina, but has not been approved in China. In November of 2013, China began categorically rejecting shipments of U.S. corn that tested positive for a trace of the genetic variant.

Plaintiffs in Syngenta Viptera corn lawsuits allege that "Syngenta knew, or should have known, that releasing Viptera would lead to the contamination of U.S. corn shipments and prevent U.S. corn from being sold to export markets such as China, which had not granted regulatory approval to MIR162,” according to court documents. Syngenta corn lawsuits are underway in multiple states, seeking class action status for agricultural businesses harmed by the presence of Viptera corn seed.
