Authorities stop shipment of counterfeit crop protection active
ingredient Iodosulfuron
- Chinese court confirms IP protection for Bayer’s active
ingredient
Following a court order, a
shipment of Iodosulfuron intended for export to the Middle East
from the port of Tianjin in China has been stopped. The
counterfeit crop protection substance, for which
Bayer CropScience
holds an IP right which is also valid in China, was produced
illegally by the Chinese companies Dagro Chemical Company Ltd.
and Qunye Chemical Company Ltd. The competent court in Tianjin
issued an order forbidding the defendants from manufacturing the
active ingredient Iodosulfuron illegally and marketing it. Both
companies must destroy any inventories immediately and pay
compensation to Bayer CropScience.
"The illegal manufacture of and trade in products not only
violate our patent rights. Illegally produced crop protection
products are untested, unregulated and are thus a danger to the
health of farmers and consumers and to the environment," said
Dr. Ralf-Rüdiger Jesse, Head of Patents and Licensing at Bayer
CropScience.
There is a rapid growth of counterfeit and illegally-traded crop
protection products in Europe and worldwide. Most of the
counterfeit products now come from China. "The rapid expansion
of chemical manufacturing capabilities in that country has made
this possible," Dr. Jesse said. He pointed out that robust
patent protection is the basis of Bayer CropScience’s innovative
strength. The company is therefore determined to defend its
intellectual property rights - which include patents, trademarks
and copyrights - against illegal manufacturers in China and
elsewhere with all the legal remedies available to it.
Iodosulfuron is an herbicidal active ingredient marketed by
Bayer CropScience under the brand name Hussar®. Launched in
1999, Hussar® is a leading foliar cereal herbicide. It is
registered in major cereal-growing countries in Europe, the
Middle East, Africa, South America, and in Australia, Russia and
Ukraine. It can be used on wheat, rye, triticale and spring
barley to control a broad spectrum of weeds, including loose
silky bent, rye grass, wild oats and broad-leaved weeds.

Aufgrund einer gerichtlichen Anordnung wurde ein für den Nahen
Osten bestimmter Transport von Iodosulfuron im Hafen von Tianjin
(China) gestoppt. Der gefälschte Pflanzenschutzmittelwirkstoff,
auf den Bayer CropScience ein auch in China gültiges Schutzrecht
hat, ist illegal von den chinesischen Unternehmen Dagro Chemical
Company Ltd. und Qunye Chemical Company Ltd. hergestellt worden.
Das zuständige Gericht in Tianjin hatte den beklagten
Unternehmen die illegale Herstellung sowie den Verkauf des
Wirkstoffs Iodosulfuron untersagt. Beide Unternehmen wurden
verurteilt, etwaige Bestände unverzüglich zu vernichten und
Schadensersatzzahlungen an Bayer CropScience zu leisten.
"Die illegale Herstellung und der Handel von Produkten verletzen
nicht nur unsere Patentrechte. Widerrechtlich hergestellte
Pflanzenschutzmittel sind aufgrund fehlender Tests und nicht
vorhandener Zulassungen auch eine Gefahr für die Gesundheit von
Landwirten, Verbrauchern sowie für die Umwelt", sagte Dr.
Ralf-Rüdiger Jesse, Leiter Patente und Lizenzen bei Bayer
CropScience.
Produktfälschungen und illegal gehandelte Pflanzenschutzmittel
verzeichnen in Europa und weltweit ein enormes Wachstum.
Inzwischen kommen die meisten Fälschungen aus China. "Möglich
wurde dies durch die rasante Kapazitätsausweitung der dort
ansässigen chemischen Produktion", erläutert Dr. Jesse. Er wies
darauf hin, dass ein gesicherter Patentschutz die Basis für die
Innovationsstärke von Bayer CropScience bilde. Daher sei das
Unternehmen entschlossen, seine Rechte an geistigem Eigentum -
beispielsweise Patente, Warenzeichen und Urheberrechte - mit
allen rechtlich zur Verfügung stehenden Mitteln gegen illegale
Produzenten auch in China durchzusetzen.
Iodosulfuron ist ein Herbizidwirkstoff von Bayer CropScience,
der unter dem Markennamen Hussar® vertrieben wird. Hussar® kam
1999 erstmals auf den Markt und ist ein führendes, über das
Blatt wirksames Getreideherbizid. Es ist in wichtigen
Getreideanbauländern in Europa, Nahost, Afrika, Südamerika,
Australien, Russland und der Ukraine zugelassen. Hussar® kann
bei Weizen, Roggen, Triticale und Sommergerste gegen ein breites
Spektrum an Ungräsern eingesetzt werden, beispielsweise gegen
