Court of Appeal’s ruling is a victory for the entire indoor farming sector - Certhon found in favor in proceedings against Plantlab

Na een jarenlange juridische strijd van Plantlab tegen Certhon, heeft na de Rechtbank ook het Gerechtshof bevestigd wat voor Certhon vanaf dag één duidelijk was: Certhon heeft op geen enkele manier inbreuk gemaakt op het octrooi op ‘indoor farming’ van Plantlab.[1]
John van der Sande, Chief Innovation Officer bij Certhon zegt hierover: “Aan de ene kant zijn wij natuurlijk ontzettend blij met deze uitspraak. Aan de andere kant is het zonde dat deze procedures zoveel extra moeite en energie hebben gekost. Met deze uitspraak kunnen wij - en vele andere bedrijven uit de sector - gelukkig verder met waar we heel goed in zijn: het ontwikkelen van betrouwbare techniek om teeltprocessen te verbeteren. We staan nog maar aan het begin van de enorme potentie van indoor farming. We zijn er klaar voor om ook de volgende stappen te gaan zetten. Deze uitspraak sterkt ons enorm.”
Plant en techniek samenbrengen
Het bedrijf blijft doorgaan met de ontwikkeling van nieuwe teeltsystemen waarmee volledige grip op het teeltproces gerealiseerd kan worden. Dat biedt enorme kansen, want hiermee kan door iedereen, waar ook ter wereld en ongeacht het klimaat, gezond voedsel geteeld worden. Transparantie is daarbij een pré. Juist door het delen van kennis is de tuinbouwsector groot geworden.

De uitspraak is een positieve stimulans om indoor farming over de hele linie heen nóg verder te ontwikkelen en te optimaliseren. “De rechtszaak heeft ons allesbehalve stil doen staan”, zegt John. “We gaan juist met nog meer energie en optimisme verder met de ontwikkeling van systemen die een optimale groei van de plant kunnen realiseren. Of het nu is een glazen kas, een gesloten kas of een kas zonder daglicht is; wij stellen de plant centraal bij het ontwikkelen van onze techniek en geven de teler hiermee de tools om zijn teelt verder te optimaliseren. Onze technieken brengen wij bij klanten over de hele wereld. Gewoon met korte lijnen en heldere afspraken. Zo hoort dat in de tuinbouw.”

[1] De Rechtbank heeft destijds ook het Nederlandse octrooi van Plantlab (NL091) vernietigd. Het Gerechtshof heeft nog geen beslissing genomen over het bezwaar van Plantlab tegen deze vernietiging van haar Nederlandse octrooi. Die beslissing wordt aangehouden in afwachting van een uitspraak van de Technische Kamer van Beroep (TKB) over de geldigheid van het Europese octrooi van Plantlab (EP 814). Als de TKB oordeelt dat het Europese octrooi van Plantlab nietig is, geldt dat ook voor het Nederlandse octrooi. Deze uitspraak van het Gerechtshof bevestigt ons vertrouwen in een goede afloop van de procedure bij de TKB.

After a legal battle of many years between Plantlab and Certhon, the Court of Appeal has confirmed what was clear to Certhon from day one: Certhon has not infringed the 'indoor farming' patent of Plantlab in any way.[1]

However, on the other hand, it is a shame that these proceedings have cost so much extra effort and energy. Fortunately, with this ruling, we can continue with what we are good at. We are ready to take the next steps, as this ruling strengthens us tremendously."

[1] In its judgment, the District Court declared Plantlab's Dutch patent (NL091) void. The Court of Appeal has not yet ruled on Plantlab's appeal to this decision regarding the validity of the Dutch patent. That decision is on hold pending a decision of the Boards of Appeal of the European Patent Office on the validity of Plantlab's European patent (EP 814). If the Boards of Appeal of the European Patent Office rules that Plantlab's European patent needs to be revoked, the same will apply for the Dutch patent. This decision by the Court of Appeal strengthens our confidence in a successful outcome of the appeal at the Boards of Appeal of the European Patent Office.
